These General Terms and Conditions apply to all contracts between André Bruns, Geschwister-Scholl-Straße 41, 28844 Weyhe, Germany (hereinafter "Provider") and users of the SCULPTÉ platform accessible at onkafit.com.
The platform provides digital fitness content including workout programs, training plans, and community features. There are two access tiers:
Registration for the free tier is available at any time and does not constitute a paid contractual relationship. Selecting a paid subscription constitutes an offer by the user to enter into a contract. The contract is concluded upon payment confirmation by Stripe. The contract language is German and English.

All prices include statutory VAT. Payment is processed via Stripe, Inc. and is due upon contract conclusion.
The free tier runs indefinitely and may be used at any time without cancellation. No charges apply and no automatic renewals occur.
Paid subscriptions (Monthly / Annual) auto-renew for the booked period unless cancelled before the end of the current billing period. Cancellation is possible at any time via account settings or by email to [email protected].
After cancellation of a paid subscription, access to premium content continues until the end of the paid period. The account then automatically reverts to the free tier. No partial refunds are issued unless the right of withdrawal is exercised within the statutory period (see § 7).
The Provider grants the user a non-exclusive, non-transferable licence to use the platform for personal, non-commercial purposes during the subscription period. Redistribution, reproduction, or commercial exploitation of content is prohibited without express written consent.
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the date of contract conclusion.
To exercise your right of withdrawal, you must inform us (André Bruns, Geschwister-Scholl-Straße 41, 28844 Weyhe, email: [email protected]) by means of a clear statement of your decision to withdraw from this contract.
If you withdraw from this contract, we will reimburse all payments received from you promptly and no later than fourteen days from the day we receive your withdrawal notice, using the same payment method you used for the original transaction.
The right of withdrawal expires early if the Provider has begun performing the service and you have expressly agreed that the Provider may begin performance before the withdrawal period expires, and you have acknowledged that you will lose your right of withdrawal upon commencement of performance (§ 356 para. 4 BGB).
By completing your subscription and immediately accessing premium content, you consent to early commencement of service delivery.

The Provider is fully liable for damages arising from injury to life, body, or health, and for intent or gross negligence. For slight negligence, liability is limited to foreseeable, contract-typical damages arising from breach of material contractual obligations.
The training content provided does not replace medical advice. Users are responsible for their own physical health and the suitability of exercises for their condition. Consult a doctor before starting any training programme if you have health concerns.
These terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only to the extent it does not deprive them of mandatory protections under their country of residence. Jurisdiction for merchants is Weyhe, Germany.
If any provision of these terms is or becomes invalid, the validity of the remaining provisions shall not be affected. Changes to these terms will be communicated to users by email.
